1. Introduction

Welcome to Elite Business Coaching Turkey. These Terms of Service ("Terms") govern your use of our website located at elitebusinesscoaching.tr (the "Site") and the coaching services provided by Elite Business Coaching Turkey ("Services"). By accessing our Site or using our Services, you agree to these Terms. If you disagree with any part of these terms, please do not use our Site or Services.

2. Use of Our Services

Our coaching services are designed to provide business guidance, mentoring, and strategic advice. The results of our coaching depend on many factors, including your commitment, business circumstances, market conditions, and other external factors beyond our control. We strive to provide high-quality coaching but cannot guarantee specific outcomes or results from our Services.

3. Eligibility

You must be at least 18 years of age to use our Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Account Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding the password you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Intellectual Property

The content, features, and functionality of the Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are the property of Elite Business Coaching Turkey, its licensors, or other content suppliers and are protected by Turkish and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The reproduction, modification, creation of derivative works, distribution, or storage of the content in whole or in part, whether or not for commercial or non-profit purposes, without express written consent from Elite Business Coaching Turkey is strictly prohibited.

6. User-Generated Content

You retain all of your ownership rights in your content that you upload, post, or display on or through the Services ("User Content"). By providing any User Content, you grant us the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content worldwide. You represent and warrant that: (i) you own the User Content or have the right to use and authorize us to use the User Content as described herein; (ii) the User Content does not violate the privacy rights, publicity rights, copyright, contractual rights, intellectual property rights, or any other rights of any person; and (iii) the User Content does not contain any defamatory, obscene, offensive, or otherwise unlawful material.

7. Prohibited Activities

You agree not to use our Services for any purpose that is prohibited by these Terms or applicable law. You shall not: (a) use the Services in any manner that could damage, disable, overburden, or impair the Services; (b) use automated scripts to collect information from or otherwise interact with the Services; (c) impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity; (d) upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or otherwise objectionable; (e) infringe any patent, trademark, trade secret, copyright, or other proprietary rights of any party; or (f) violate any applicable local, state, national, or international law.

8. Payment and Refunds

Payment for our coaching services must be made in accordance with the payment terms set forth at the time of your purchase. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. We understand that circumstances may arise that prevent you from attending a scheduled coaching session. Our refund policy allows for full refunds if canceled at least 48 hours before the scheduled session. Cancellations made less than 48 hours before a session may be subject to a cancellation fee. For group coaching programs and workshops, refund policies will be specified at the time of purchase.

9. Limitation of Liability

In no event shall Elite Business Coaching Turkey, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Indemnification

You agree to defend, indemnify, and hold harmless Elite Business Coaching Turkey and its licensees, licensors, employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Services.

11. Third-Party Links

Our Services may contain links to third-party websites or services that are not owned or controlled by Elite Business Coaching Turkey. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Elite Business Coaching Turkey shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have had between us regarding the Services.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
